1.These rules and terms and conditions are the rules (“Rules”) which apply to the Facebook and Instagram Competition (“Competition”) on the Gro Company Australia Facebook page at https://www.facebook.com/TheGroCompanyAUS/ and The Gro Company Australia Instagram page at https://www.instagram.com/thegrocompanyaus/ By entering the Competition, entrants agree to be bound by these Rules.
2.The Competition is organised by Mayborn ANZ Pty Ltd ABN: 66 154 703 134 being a company incorporated in Australia whose registered office is at Suite 21, Hallmark Office Park,15 Ricketts Rd, Mt Waverley, Melbourne, Victoria, 3149, Australia (“Mayborn”). Mayborn Group is a business name of Mayborn ANZ Pty Ltd . Mayborn is the promoter of this Competition.
3.In the event of any dispute regarding the Rules, results and any issues relating to the Competition, the decision of Mayborn shall be final and no correspondence or discussion shall be entered into.
4.Employees (or members of the families or households of employees) of Mayborn and any of Mayborn’s associated companies, are not eligible to enter the Competition.
5.By entering the Competition, you confirm that all information submitted by you is true, current and complete.
6.The Competition is open to residents of Australia aged 18 years or over. Any resident outside of Australia is not eligible.
7.Entry to the Competition must be made online by visiting the Gro Company Australia Facebook page at https://www.facebook.com/TheGroCompanyAUS/ (“Facebook Page”) or Gro Company Australia Instagram Page https://www.instagram.com/thegrocompanyaus/ (“Instagram Page”). All entrants must provide the personal information requested on the relevant page(s) of the Facebook or Instagram Page relating to the Competition and in any subsequent correspondence from Mayborn. No purchase is necessary in order to enter the Competition and there is no charge to register. If you wish to enter via the Facebook Page or Instagram page, you will need a Facebook account on Facebook.com or an Instagram account on Instagram.com and must enter the competition via the Facebook page or Instagram page. If you are a first time visitor to Facebook or Instagram, you will be prompted to complete the on-screen registration form to sign up for a Facebook account on Facebook.com or an Instagram account on Instagram.com and provide a username, email address and password. There is no charge for an account on Facebook or Instagram. Such registration on Facebook or Instagram is a one-time requirement. If you are a returning visitor, you will be prompted to log in using your e-mail address or username and/or password. Anyone found to be using multiple accounts to enter will be disqualified. Entrants are responsible for their own costs associated with accessing the Internet.
8.Once entrants visit the Facebook Page or Instagram Page, they must follow the prompts to provide their answer, in 25 words or less to a question or a photo, as stated on the Facebook or Instagram Page and provide any other details or complete required actions as stated on the Facebook/Instagram Page. Each “25 words or less” statement or photo must be the entrant’s original work. By entering this Competition entrants: (a) consent to Mayborn making copies of or publishing the whole or any part of their entry (including the “25 words or less” statement) and otherwise exploiting the entry and any rights in relation to the entry, to publicise this Competition or for any other purposes; and (b) undertake to Mayborn that their entry is not in breach of any third party intellectual property rights.
9.If an entry to the Competition includes a photograph (the “Photo”), by entering the competition you consent to and grant Mayborn a license to copy and use the Photo in any and all media now known or hereinafter developed. You also confirm that you have the right to give such consent with respect to any person appearing in said Photo. The entrant (and if entrant is a minor, the entrants guardian on behalf of the entrant) (a) hereby grants Mayborn in perpetuity, a world-wide, royalty-free, non-exclusive license in the copyright of the Photo, and all copyright and similar rights subsisting in the Photo, in any part of the world, to which the entrant is, or may become, entitled; (b) hereby grants Mayborn the right and license to publish, display, reproduce, modify, edit or otherwise use the Photo (i) in any format or media; (ii); in any advertising or marketing relating to the Competition or the prizes; and/or (iv) in any other way Mayborn sees fit at its discretion; and (c) waives all moral rights in and to the Photo in favour of Mayborn and anyone authorized by Mayborn to reproduce or otherwise use the Photo. By entering the Competition, the entrant understands that he/she will not be entitled to any compensation for any use of the Photo by Gro Company Aust.
10.The Competition will begin and end at the times and dates as stated on the Facebook/Instagram Page. All times stated are Australian Eastern Standard Time.
11.Winners will be announced within 7 days of the closing date of the Competition. Only one prize per winning entrant will be awarded.
12.The prizes shall be as stated on the Facebook Page and Instagram Page and shall be chosen by Mayborn in collaboration with Icon Agency. There is no cash alternative and prizes are not transferable. Mayborn reserves the right to substitute prizes of equal or greater value at any time. Prizes are subject to any additional conditions as imposed by the supplier(s).
13.The prize winners will be notified via the Facebook/Instagram Pages Once notified, the winners must provide their address & contact details for the purposes of prize fulfillment by private messaging the Facebook / Instagram Page within 48 hours, failure to reply within stated time may result in the selection of an alternate winner.
14.There is only one prize awarded between Facebook and Instagram entrants.
15.Mayborn and its associated agencies and companies will not be liable for any damage, loss or delay in transit to prizes.
17.By participating in the Competition, entrants agree to release and hold harmless Facebook and Instagram from any and all liability for any injuries, losses or damage of any kind which may arise in connection with the Competition or the acceptance and/or use of any prize. Facebook is a registered trademark of Facebook, Inc. The Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram. By entering the Competition, you understand that you are providing your information to Mayborn and not to Facebook or Instagram.
18.Mayborn reserves the right to cancel or amend the Competition or the Rules without notice at any time, if considered necessary by Mayborn in its opinion or if circumstances arise which are outside of Mayborn’s reasonable control. Any changes will be posted within Rules on the Facebook and Instagram Pages.
19.The Competition and Rules will be governed by Australian law and any disputes will be subject to the exclusive jurisdiction of the Courts of Australia.
20.Mayborn is not liable for any tax implications arising from prize winnings. Independent financial advice should be sought. Where this Competition involves, for GST purposes, supplies being made for non-monetary consideration, entrants will follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
